The Good Behaviour Clause Inquiry

Paper for the Competition Commission. The 'good behaviour' clause adds another substantive layer of sector regulation to the electricity industry, at a time when significant structural changes are taking place, when NETA is being introduced, and when the Competition Act powers have just come into effect. This paper considers what the nature of the problem in electricity generation is, and argues that the good behaviour clause is an inappropriate mechanism for addressing market imperfections.
